Patent Pending Technology

10am's ambient audiovisual entrainment system and method are patent pending. This proprietary technology is protected by intellectual property laws and international treaties.

Agreement to Terms

By accessing or using 10am, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access the service.

Description of Service

10am provides an ambient cognitive entrainment system for your desktop environment, using synchronized audiovisual stimulation to support focus, relaxation, and other cognitive states. The service includes:

  • Desktop application for Windows and macOS
  • Audiovisual entrainment with customizable frequency parameters
  • AI-assisted session configuration based on your goals
  • Optional calendar integration (Google Calendar and Microsoft Outlook) for automated cognitive support
  • Optional Adaptive Mode using camera-based eye tracking to automatically adjust stimulation based on your attention state
  • Optional OS Context Sensing using keyboard timing, mouse dynamics, and active application detection to infer cognitive state and adjust stimulation
  • Optional Music Coherence using microphone (or system audio on macOS) to detect the key and tempo of music in your environment and align 10am's stimulation parameters to it
  • Optional Hesper, an in-app conversational companion powered by OpenAI that can suggest settings adjustments which you apply or undo with a single click
  • Optional local Context API, which lets tools running on your own computer read an abstracted view of your current 10am state through a localhost-only HTTP server you authorize with a key you generate
  • Cloud synchronization of preferences and usage data

Health & Safety Disclaimer

10am is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The audiovisual entrainment features are designed for general wellness and cognitive support purposes only.

Photosensitivity warning: 10am uses flickering visual overlays that may trigger seizures in individuals with photosensitive epilepsy or similar conditions. If you have a history of epilepsy, seizures, or photosensitivity, consult your physician before using 10am.

Discontinue use immediately if you experience any discomfort, dizziness, nausea, headache, eye strain, or visual disturbances while using the application.

By using 10am, you acknowledge that you use the audiovisual entrainment features at your own risk and that Halotropic, Inc. is not liable for any adverse health effects resulting from use of the service.

Optional Sensing & AI Features

Certain optional features of 10am collect and process biometric, behavioral, audio, or conversational data, and certain features transmit derived information off your device. Each is disabled by default. By enabling any of them, you acknowledge and agree to the terms in this section. Full details on what is collected, what is transmitted, and what is retained are in our Privacy Policy.

Adaptive Mode (Camera / Eye Tracking)

  • Enabling Adaptive Mode grants 10am access to your device's camera for the purpose of real-time eye tracking and attention state detection
  • Camera frames are processed on your device by an on-device model (MediaPipe) and immediately discarded — no images are stored or transmitted
  • Raw biometric metrics (e.g., blink rate, fixation stability, pupil diameter) and derived attention abstractions are kept on your device and are never transmitted to our servers or any third party
  • If you enable the local Context API (described below), tools running on your own computer can read derived attention abstractions through a localhost-only HTTP server using a key you generate. Even in this case, no data is transmitted off your device
  • You may disable Adaptive Mode and delete all associated data at any time from the app settings; doing so immediately stops camera access and data collection

OS Context Sensing

  • Enabling OS Context Sensing allows 10am to monitor keyboard timing patterns, mouse dynamics, the active foreground application, and its window title for the purpose of inferring your cognitive state on your device
  • Keystroke content is never captured — only timing metadata (inter-key intervals, typing velocity, pause frequency, error rate)
  • Raw keyboard timing values, raw mouse dynamics, the active application name, window titles, and the derived cognitive state scores are kept on your device and are never transmitted to our servers or any third party
  • If you enable the local Context API (described below), tools running on your own computer can read derived cognitive state scores and a task-type label through a localhost-only HTTP server using a key you generate. Raw keyboard timing, raw mouse dynamics, window titles, and specific application names are not exposed through that interface. Even in this case, no data is transmitted off your device
  • You may disable OS Context Sensing and delete all associated data at any time from the app settings

Music Coherence (Microphone)

  • Enabling Music Coherence grants 10am access to your device's microphone (or, on macOS, optionally to system audio) so it can detect the musical key and tempo of audio in your environment
  • Audio samples, recordings, voice content, and conversations are never stored. Only derived musical features (a chroma vector, an estimated tempo, and a confidence value) are computed in real time and held briefly in memory while the feature is active
  • No microphone data, audio, or derived musical feature is ever transmitted to our servers, OpenAI, or any other third party — all processing is local
  • You may disable Music Coherence at any time from the Music Coherence card in the app, or revoke microphone permission at the operating system level

Hesper (In-App Companion)

  • Hesper is an optional in-app conversational companion powered by OpenAI's GPT family of models (currently gpt-5.4-mini). When you send Hesper a message, your recent chat history with Hesper and a runtime context block (a snapshot of your cognitive state and, if you have enabled Context History, a summary of the past 60 minutes) are transmitted to OpenAI for processing
  • Camera data, microphone data, raw biometric metrics, raw keyboard/mouse timing, window titles, and active application names are not transmitted to OpenAI
  • Hesper may suggest specific 10am settings adjustments and present them as "proposal cards" inside the chat. You apply or undo each proposal with a single click. Hesper is restricted to a fixed allowlist of settings keys and cannot read or write any other part of your account, your device, or your data. Proposed changes are not applied automatically
  • Per OpenAI's API terms, requests sent through the OpenAI API are not used to train OpenAI's models. OpenAI's handling of API request data is governed by OpenAI's own privacy policy
  • You may stop using Hesper at any time. Not opening or sending messages in the Hesper panel means no Hesper data is transmitted

Local Context API & Authorized Local Tools

  • The Context API is an optional, fully local feature that lets tools running on your own computer — for example, a desktop AI assistant, a personal automation, or a script you've written — read an abstracted, semantic view of your current 10am state. It runs as an HTTP server on 127.0.0.1 (localhost) inside the 10am app and is not reachable from the network. The Context API is off by default and is enabled from Settings → Context API → Enable Context API
  • The Context API does not transmit data off your device. The local server only responds to requests from programs running on the same computer; it does not call out to our servers, to OpenAI, or to any other third party. The exact data exposed to authorized local tools is described in the Privacy Policy
  • You authorize local tools by generating one or more API keys from inside the 10am app and providing a key to each tool. Keys are stored encrypted on your device using your operating system's secure-storage facility and can be revoked at any time. Any tool without a valid key is rejected by the local server
  • You are responsible for the local tools you authorize and for the actions they take using your key. If you authorize a tool that itself transmits data to a third-party service or to the internet, that transmission is governed by that tool's own terms and privacy policy, not by 10am or by Halotropic, Inc. Halotropic, Inc. is not responsible for the conduct of third-party tools or AI assistants you authorize, including for any data they collect, transmit, or act upon
  • You agree not to authorize tools to perform actions that would violate applicable law, infringe the rights of others, or violate the Prohibited Uses section of these Terms
  • Turning Context API off immediately stops the local server and prevents authorized tools from reading further state. Disabling Context History additionally purges the local history store

Geographic Availability of Sensing Features

10am's sensing features — Adaptive Mode (camera-based eye tracking), Activity Sensing (keyboard, mouse, and active-application timing), and Smart Sensing (cognitive-state derivation from those signals) — are currently available only to users located in the United States, excluding Illinois and Washington (collectively, the "Supported Region").

Illinois is excluded because of the private right of action under the Biometric Information Privacy Act (BIPA, 740 ILCS 14). Washington is excluded because of the private right of action under the My Health My Data Act (RCW 19.373), which we treat as covering the cognitive-state inferences 10am derives from sensing. Sensing features are not currently offered outside the United States because we do not yet operate the controller-side machinery (including any designated representative, data protection impact assessment, lawful cross-border transfer mechanism, or separate consent surface) required by regimes such as the EU and UK GDPR, Swiss FADP, PIPL in China, PIPA in South Korea, LGPD in Brazil, DPDPA in India, and analogous laws.

When you choose to enable a sensing feature, 10am will automatically detect your approximate location using IP geolocation. If your location cannot be confirmed, or if your detected location is outside the Supported Region, sensing features are blocked. 10am does not offer a self-attestation override: there is no checkbox, certification, or written statement that will unblock sensing features for a user outside the Supported Region. All non-sensing features of 10am (manual audiovisual entrainment, presets, frequency settings, music coherence, Hesper, Context API authorization) remain fully available regardless of your location.

You agree not to circumvent or attempt to circumvent the geographic gate — including but not limited to using a VPN, proxy, false IP attribution, falsified responses to location prompts, modification of the 10am client, or any other technical or behavioral means of presenting a location other than your true one — for the purpose of enabling sensing features outside the Supported Region. If you relocate to a jurisdiction outside the Supported Region after enabling a sensing feature, you must immediately disable Adaptive Mode, Activity Sensing, and Smart Sensing in the app settings. Continued use of sensing features outside the Supported Region constitutes a breach of these Terms and grounds for account termination.

If you enable or continue to use sensing features outside the Supported Region by circumventing the geographic gate or by failing to disable sensing features after relocating, you agree that:

  • You are solely responsible and liable for any violation of applicable biometric, consumer-health, or general data-protection laws arising from your use of those features
  • You waive and release Halotropic, Inc. from any and all claims, damages, or causes of action arising under any biometric, consumer-health, or data-protection statute, including but not limited to BIPA, MHMDA, GDPR, UK GDPR, FADP, PIPL, PIPA, LGPD, and DPDPA, to the maximum extent permitted by law
  • You agree not to bring any legal action against Halotropic, Inc. related to the collection, storage, or processing of biometric, behavioral, or cognitive-state data under any such statute
  • You agree to indemnify Halotropic, Inc. for any claims, damages, or legal costs arising from your use of sensing features outside the Supported Region

Nothing in this section is intended to waive any right that cannot be waived under applicable law. If a court of competent jurisdiction determines that any portion of the foregoing waiver, release, or indemnification is unenforceable as to a particular claim, the remainder of this section will continue in full force and effect.

Enterprise Use & Indemnification

If 10am is provided to you through your employer, organization, or any third party ("Sponsoring Organization"):

  • The Sponsoring Organization is responsible for ensuring that its employees and users comply with all applicable biometric, consumer-health, and data-protection laws before enabling sensing features, and for ensuring that no employee or user enables a sensing feature outside the Supported Region
  • The Sponsoring Organization agrees to indemnify, defend, and hold harmless Halotropic, Inc. from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from any employee's or user's use of sensing features in violation of applicable biometric, consumer-health, or data-protection laws
  • Enterprise deployment of sensing features in additional jurisdictions may require a separate agreement. Contact legal@go10am.com for enterprise licensing

Data Retention & Deletion

  • Biometric and behavioral event logs are stored locally on your device, encrypted at rest, and automatically deleted after 6 months. The local analytics dashboard summary (semantic labels only, no raw data) is automatically deleted after 90 days
  • 10am does not operate a server that receives, stores, or processes your sensing data. Raw biometric metrics, raw keyboard/mouse timing values, window titles, active application names, microphone data, derived cognitive state, and camera frames are never transmitted to 10am's servers or any third party
  • You may request deletion of all locally stored data at any time through the app settings
  • Upon account deletion, all cloud-stored account data (e.g., Firebase authentication record, Stripe customer reference) is permanently removed. Locally stored sensing data can be deleted from the app or by uninstalling the application
